Personal information privacy policy
This Personal information privacy policy (hereinafter referred to as the “Privacy policy”) shall apply to any information that the SPbEС-Mining (hereinafter referred to as “SM”) website hosted on the spbec-mining.ru domain (and its subdomains) can obtain about the User during the use of the spbec-mining.ru website (and its subdomains) as well as its programs and products.
1. Terms and definitions
1.1 The following terms shall be used in this Privacy policy:
1.1.1. “Website administration” (hereinafter referred to as the “Administration”) shall mean the staff members who are authorized to manage the SPbEС-Mining website, involved in processing personal information and/or making the respective arrangements and define the purposes of processing personal information, the scope of personal information subjected to processing and the measures (operations) to be undertaken with personal information.
1.1.2. “Personal information” shall mean any information related to a directly or indirectly specified individual (personal information owner).
1.1.3. “ Personal information processing” shall mean any measure (operation) or combination of measures (operations) performed with personal information using or without using automated equipment, including collection, recording, classification, accumulation, storage, updating (refreshment, alteration), retrieval, utilization, communication (distribution, provision, accessing), depersonalization, blocking, removal and destruction of personal information.
1.1.4. “Personal information privacy” shall mean the requirement to prevent the distribution of personal information without its owner’s consent or other legal grounds, which is binding upon the Operator or another person who is given access to personal information.
1.1.5. “SPbEС-Mining website” shall mean the combination of interrelated web pages hosted at the spbec-mining.ru Uniform Resource Locator (URL) on the Internet, and its subdomains.
1.1.6. “Subdomains” shall mean SPbEС-Mining website pages or combination of pages hosted at third-level domains and other provisional pages with contact details of the Administration provided below.
1.1.7. “SPbEС-Mining website user” (hereinafter referred to as the “User”) shall mean the person who is given access to the SPbEС-Mining website via the Internet and uses SPbEС-Mining website information, content and products.
1.1.8. “Cookies” shall mean a small chunk of data sent by the web server and stored on the User’s computer, which is forwarded to the web server in HTTP requests by the web client or the web browser every time when the respective website page is attempted to be opened.
1.1.9. “IP address” shall mean the Uniform Resource Locator of the computer network hub, which is used by the User for obtaining access to SM.
2. General
2.1. By using the SPbEС-Mining website the User shall agree with this Privacy policy and the conditions for processing the User’s personal information.
2.2. In case that the User disagrees with terms and conditions of the Privacy policy, he shall stop using the SPbEС-Mining website.
2.3. This Privacy policy shall be applicable to the SPbEС-Mining website. SM shall not control or assume responsibility for third party websites that the User can visit by following the links available on the SPbEС-Mining website.
2.4. The Administration shall not verify the accuracy of personal information provided by the User.
3. Subject matter of the Privacy policy
3.1. This Privacy policy shall stipulate the Administration’s obligations related to non-disclosure and privacy protection of personal information provided by the User at the Administration’s request when signing up on the SPbEС-Mining website or subscribing to the newsletters.
3.2. Personal information that can be processed under this Privacy policy shall be provided by the User by completing forms on the SPbEС-Mining website. It includes the following information:
3.2.1. the User’s full name;
3.2.2. the User’s contact telephone number;
3.2.3. e-mail address;
3.2.4. the User’s place of residence (where applicable)
3.2.5. photograph (where applicable)
3.3. SM shall protect the Information that is automatically communicated when visiting the following pages:
• IP address;
• information from cookies;
• information about the browser;
• access time;
• referrer (address of the previous page).
3.3.1. Disabling the cookies may result in preventing access to website sections that require logging in.
3.3.2. SM shall collect statistics on the IP addresses of its visitors. This information shall be used to prevent, detect and handle technical issues.
3.4. Any other personal information that is not mentioned above (browsing history, existing browsers, operating systems, etc.) shall be subject to reliable storage and non-disclosure except as otherwise provided by para. 5.2. hereof.
4. Purposes of collecting the user’s personal information
4.1. The Administration can use the User’s personal information for the following purposes:
4.1.1. Identifying the User who is signed up to the SPbEС-Mining website for the purposes of his subsequent logging in.
4.1.2. Providing the User with access to personalized data on the SPbEС-Mining website.
4.1.3. Organizing two-way communication with the User including the forwarding of notices and requests concerning the use of the SPbEС-Mining website and the processing of the User’s requests and inquiries.
4.1.4. Identifying the User’s location to ensure safety and prevent fraud.
4.1.5. Verifying that the personal information provided by the User is accurate and complete.
4.1.6. Creating a user account for utilizing certain sections of the SPbEС-Mining website provided that the User has given his consent.
4.1.7. Emailing notices to the User.
4.1.8. Providing the User with effective technical support if any problems arise in relation to using the SPbEС-Mining website.
4.1.9. Providing the User with special offers, newsletters and other information on behalf of the SPbEС-Mining website upon his consent.
5. Methods and deadlines for processing personal information
5.1. Personal information of the User shall be processed for an unlimited period of time and using any legal method including personal data information systems with or without the use of automated equipment.
5.2. Personal information of the User can be communicated to competent public authorities of the Russian Federation only on the grounds and in the manner prescribed by the law of the Russian Federation.
5.3. In the event of losing or disclosing any personal information, the Administration may choose not to notify the User thereof.
5.4. The Administration shall take any necessary technical and organizational measures to protect the User’s personal information from unauthorized or random access, destruction, modification, blocking, copying, distribution or other inappropriate actions taken by third parties.
5.5. The Administration, in liaison with the User, shall take any necessary measures to prevent damages or other negative consequences resulting from loss or disclosure of the User’s personal information.
6. Rights and obligations of the parties
6.1. The User’s rights:
6.1.1. Making a free decision regarding the provision of his personal information that is necessary for using the SPbEС-Mining website and giving his consent to process it.
6.1.2. Updating and complementing the provided personal information when making changes to it.
6.1.3. The User shall have the right to obtain information from the Administration, which is related to processing his personal data unless such a right is restricted by federal laws. The User shall have the right to demand from the Administration to update, block or destroy his personal information in case when it is incomplete, outdated, inaccurate, illegally obtained or unnecessary for the stated purpose of processing, and to take legal measures for protecting his rights. This can be done by informing the Administration using the provided email address.
6.2. The Administration’s obligations:
6.2.1. Using the obtained information only for the purposes specified in para. 4 hereof.
6.2.2. Keeping any confidential information secret and non-disclosed without the User’s prior written approval; the obtained User’s personal information cannot be sold, exchanged, published or disclosed using other possible methods except as provided by para. 5.2. hereof.
6.2.3. Taking precautionary measures for protecting the privacy of the User’s personal information according to the procedure that is normally used for protecting such information in the existing business practices.
6.2.4. Blocking any personal information related to a particular User upon receiving a request or inquiry from the User, his legal representative or the authorized body responsible for protecting personal information owners’ rights for the duration of the inspection period, in the event of revealing inaccurate personal information or inappropriate actions.
7 Liabilities of the parties
7.1. The Administration, which is in default of its obligations, shall be held liable for any damages incurred by the User in connection with unauthorized usage of personal information, in accordance with the law of the Russian Federation except as otherwise provided by paras. 5.2. and 7.2. hereof.
7.2. The Administration shall not be held liable in the event of losing or disclosing Confidential information to the extent where such information:
7.2.1. Became available to the public prior to its loss or disclosure.
7.2.2. Was obtained from a third party earlier than by the Resource Administration.
7.2.3. Was disclosed with the consent of the User.
7.3. The User shall be held fully liable for compliance with the law of the Russian Federation including but not limited to advertising laws, copyright and related right protection laws and trademark and service mark protection laws, and including unlimited liability for provided content and format.
7.4. The User shall agree that the liability for any information (including but not limited to data files, texts, etc.) that is accessible by him as part of the SPbEС-Mining website will be held by the person providing such information.
7.5. The User shall agree that the information provided to him as part of the SPbEС-Mining website can constitute intellectual property, the rights to which are protected and owned by other Users, partners or advertisers who post such information on the SPbEС-Mining website. The User shall not have the right to make changes to, rent out, lend, sell, distribute or create any derivative works on the basis of such Content (in full or in part) except when these measures are expressly authorized in writing by the owners of such Content under the terms of a separate agreement.
7.6. Text content (articles and publications that are freely and publicly available on the SPbEС-Mining website) can be distributed on the condition that reference will be provided to SM.
7.7. The Administration shall not be held liable to the User for any losses or damages incurred by the User as a result of deletion, failure or inability to preserve any Content or other communication data provided on the SPbEС-Mining website or communicated through it.
7.8. The Administration shall not be held liable for any direct or indirect losses resulting from using or failing to use the website or particular services, unauthorized access to the User’s communications or any third party’s statement made or behavior demonstrated on the website.
7.9. The Administration shall not be held liable for any information posted on the SPbEС-Mining website by the User including but not limited to any information protected by copyright, without the express content of the copyright holder.
8. Settlement of disputes
8.1. A claim (written or electronic proposal to settle a dispute on a voluntary basis) must be submitted prior to filing a claim with a court in relation to disputes arising from the relationship between the User and the Administration.
8.2. The claimee shall notify the claimant of the claim review results in written or electronic form within 30 calendar days from receiving the claim.
8.3. In the event that no agreement is reached, the dispute shall be referred to the Moscow Arbitration court.
8.4.This Privacy policy and the relationship between the User and the Administration shall be regulated by the applicable laws of the Russian Federation.
9. Additional terms and conditions
9.1. The Administration shall have the right to amend this Privacy policy without the User’s consent.
9.2. The revised Privacy policy shall become effective immediately after it is posted on the SPbEС-Mining website unless otherwise provided by the revised version of the Privacy policy.
